EdUnlimited is a personalised subscription service that allows our members to access educational resource materials via our website through multiple devices.
These User terms and conditions (“Terms”) apply to the use of this Website, the Service and to the use and purchase of Materials and other goods and services from us.
In using this Website and Service you agree to be bound by these Terms. If you do not accept these Terms, you must refrain from using the Website and Services or purchasing goods/services through it.

Your access to and use of the Website and Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. You must register to become a Member in order to transact on the Service.

We reserve the right to accept or refuse access/ Membership or to restrict use of the Service in our discretion. You may not transfer or assign your Membership. We may take action we deem reasonably necessary to prevent fraud and abuse, including placing restriction on the amount of Materials you may access at any time.

You warrant that you are at least 18 years old and are legally capable of entering into binding contracts, or, if under 18 years old that you have obtained consent from your parent or guardian and that they agree to be bound by these Terms on your behalf.

Upon registration we may collect information such as your name, address, email address and phone number, as well as credit card or other payment details. You agree to provide accurate and complete information and to keep this information updated when interacting with us. We will use your personal information in accordance with our privacy policy. This may include the provision of your details to related entities of EdUnlimited. Where you opt-in to doing so, we may provide your email details to third party educational institutions and others for marketing purposes.

You must not use another person’s account, password or log-in details for any reason, unless permitted by us in writing.

You are solely responsible for any activity occurring on your account. You must keep your account details secret and secure, including login and password details. You are fully responsible for activities that occur through use of your password and account. If you suspect unauthorised use of your account or that your password is no longer secure, you must notify us immediately.

You agree and acknowledge that in the event we suffer loss or damage as a result of a minor purporting to enter into a transaction with us, we reserve the right to take legal action and seek recompense from the parent or guardian of that minor.

Your Membership will continue month-to-month until terminated. Subscription fees are payable monthly in advance. If you terminate your Membership early then you are not entitled to any refund of fees paid in advance unless required by law.

We may from time to time offer various Membership plans and may change them and their features from time to time. If you sign up for a Membership plan, you agree to the terms, conditions and limitations associated with them that are posted on our Website (if and to the extent differing from or supplementing these Terms).

We may from time to time offer certain customers various trial or other promotional Memberships, which are subject to these Terms except as otherwise stated in the promotional offer and will be subject to clause 3.8 where applicable. We reserve the right to determine your eligibility for same in our sole discretion. Trial Members may, at any time choose not to continue to paid Membership by cancelling prior to the end of the trial period.

If a trial offer requires you to have a valid payment instrument kept on file, such as a credit card or other permitted payment method, we may validate that payment including by requesting a temporary authorisation from the financial institution issuing your payment instrument. If we determine that your payment instrument is invalid, without limiting any of our rights, we may revoke any benefits, credits or Materials you may have received as part of the offer.

If all credit cards we have on file for you are declined for payment of your Membership fees, your Membership will be cancelled unless you provide us with a new credit card. If you provide with a new credit card and are successfully charged before your Membership is cancelled, your new Membership period will be based on the original renewal date and not the date of the successful charge.

Membership fees are stated at our Website. From time to time we may offer different Membership terms and fees for such Membership may vary. Membership fees may be subject to GST and are non-refundable except as expressly set out in these Terms.

All prices for goods and services that are for sale are listed on the Website are listed in AUD. Prices include GST where applicable. Prices are current at time of display but are subject to change on prior notice.

Additional terms and conditions may apply to purchases of Materials for sale or other goods or services and to specific portions or features of the Service, including special promotions or other similar features, all of which terms are made a part of these Terms by reference. You agree to comply with such other terms. If there is a conflict between these Terms and the terms posted for or applicable to a specific goods/ services offered on or through the Service, those latter terms shall prevail.

Payment must be effected in the manner described on the Website (credit card, debit card and any other method indicated such as Stripe) and must be received prior to dispatch of or provision of access (as the case may be) to Materials and Membership.

You warrant that there will be sufficient funds or credit facilities to cover the order amount. We reserve the right to obtain validation of your payment details before dispatching or providing access to Materials supplied by sale.

| 3.6 |
You acknowledge that despite our reasonable precautions, Materials for sale may be listed at an incorrect price or with incorrect information due to a typographical error or like oversight. In these circumstances, we reserve the right to cancel the transaction, notwithstanding that your order has been confirmed and your credit card has been charged. If a cancellation of this nature occurs after your credit card has been charged for the purchase, we will immediately issue a credit to your credit card account for the amount in question.

We reserve the right to refuse or cancel access to Materials at any time for reasons including but not limited to product or service unavailability, errors in the description or price of a product or service or error in your order, suspected or actual fraud or unauthorised or illegal transaction.

At the end of the first and any following Membership period your Membership will automatically renew unless you notify us before a charge that you want to cancel or do not want to automatically renew. You agree and acknowledge that your Membership will automatically continue and you authorise us (without notice to you, unless required by applicable law to collect the then-applicable Membership fees and any taxes, using any credit card we have on record for you.

As part of a Membership plan, we may issue credits redeemable for Materials. Credits are non-transferrable and non-refundable. Credits are valid for a limited time as described in the applicable Membership and promotional terms and conditions. Credits expire immediately upon the cancellation or termination of your Membership unless used prior to cancellation or termination.

You agree that you will not post, upload, transmit or make available on the Service, User Content that:
- is defamatory of another user or any other person, incites hatred or discrimination against any person or group of persons, is racist, homophobic, misogynistic, abusive, hateful, threatening, hostile, intimidating, bullying, harassing, constitutes “trolling” or involves an invasion of privacy;
- is inaccurate, erroneous, irrelevant or off-topic;
- is misleading, false or deceptive (whether by representations or omissions);
- infringes any third party's intellectual property rights (including copyright) or breaches confidentiality. Where User Content involves any copyright material you must not post it unless you own the copyright or have the written consent of the copyright owner;
- contains or depicts pornography, nudity, sexual acts or references, is vulgar, obscene or profane, is inflammatory or contains expletives;
- includes a photograph or other likeness, or personal or private information of another person without their consent or impersonates another person or misrepresents your relationship with any person;
- promotes, encourages or provides information about unlawful conduct or activities or is otherwise unlawful;
- contains or is used to disseminate any unsolicited or unauthorised advertising or promotional material including spam, chain letters and the like, is used to promote pyramid schemes; or
- contains viruses, worms or other types of malicious or harmful programs, nor take any action that imposes an unreasonable or disproportionately large load on our infrastructure.

You must not damage, modify, interfere with, disrupt or destroy the files, data, passwords, devices or resources that belong to us or do anything that compromises the security of the Service or Materials.

You remain solely responsible and liable in respect of any User Content that you may post. We reserve the right to remove any User Content that you or any other user posts at any time without notice to you. However, you acknowledge that we do not routinely pre-screen, monitor, check or review User Content.

We reserve the right to remove any objectionable User Content and will endeavour to remove material that we deem objectionable within a reasonable time after considering whether it violates these Terms and Conditions.
